Last Tuesday, August 23, 2022, a decree (the “Decree”), issued by the Ministry of Energy (“SENER”) creating the new Decentralized Public Body called “Lithium for Mexico” (“LitioMx”) was published in the Federal Official Gazette, which will have the authority to perform activities of exploration, exploitation, profiting and utilization of lithium in our country, as well as the administration and control of the value chain of such mineral.

Today, an agreement was published in the Official Federal Gazette, whereby the Ministry of Health adopts additional extraordinary measures to mitigate and control the COVID-19 disease, including the immediate suspension until April 30, 2020, of all non-essential activities in the public, private and social sector.

A decree was published in the Official Federal Gazette last night in which the President of the Republic declares various extraordinary actions that the Ministry of Health can implement immediately in all regions of the country that are affected by the COVID-19 disease.

On December 1, 2021, the First Chamber of the Supreme Court of Justice of the Nation (SCJN) issued a decision that authorizes a single company to plant, cultivate and harvest hemp, with a concentration equal to or less than 1% of Tetrahidrocannabinol or THC, for the production of products for wide industrial use.

Yesterday the Chamber of Deputies announced the approval opinion of the reform bill to regulate subcontracting, which bill was presented at the end of last year by the Federal Executive Branch. The laws that will be affected by the reform are the Federal Labor Act, the Social Security Act, the National Workers Housing Fund Institute Act, the Federal Tax Code, the Income Tax Act (hereinafter, IT) and the Value Added Tax Act (hereinafter, VAT).

We previously informed you of the approval of the reform bill to regulate subcontracting in the Chamber of Deputies. Following up on this, we are informing you that today it was approved in the Chamber of Senators. This means that the reform has been fully approved, and that it will enter into force with its publication in the Official Federal Gazette (DOF), probably May 1 or before.

Although the approved Economic Package for Fiscal Year 2022 did not increase the Income Tax rate (ISR) to be paid by legal entities, it does contain a modification whose practical effect will be that many Mexican auto parts companies pay more ISR for the maquila operation they carry out.

On June 8, 2020, the Plenary of the Federal Judicial Council (“CJF”) entered the Decrees 12/2020, 13/2020 and 14/2020 (“CJF Decrees”) which state the work structure that the Federal Judiciary will adopt during the period from June 15-30, 2020, and also address the electronic processing of proceedings.

On October 18, 2021, the “Resolution instructing the indicated agencies to take actions in relation to the definitive importation of used vehicles” was published in the Federal Official Gazette, in which the President of the Republic instructs certain governmental agencies to adopt measures for the regularization of used vehicles of foreign origin whose legal stay in the country cannot be proven.

On December 6, 2021, the Biden administration published the first-ever United States Strategy on Countering Corruption. This has as precedent June 3, 2021, President Biden’s National Security Study Memorandum-1 (NSSM-1) which established the fight against corruption as a “core national security interest of the United States.”
