Introduction

As we mentioned in part three of the document "ESG in the Mexican Mining Industry", climate change and energy efficiency issues, now more than ever, play a very relevant role in the industry. This is because in the mining sector, most of the greenhouse gas ("GHG") emissions are directly related to energy consumption. GHG emissions are mainly produced by the burning of fossil fuels to supply electricity to the mines, as well as to power equipment and vehicles for the extraction and processing of minerals and metals. This intensive energy consumption is expected to increase exponentially in the coming years.

On the past October 5th, 2022, the Eu­ropean Council published the agreed text of the Markets in Crypto-Assets (MiCA) Regulation, which aims to regulate crypto-assets related activities carried on in the EU. MiCA provides rules for several areas including transparency, disclosure, supervision and protection in the offering, is­suance, trading and marketing of crypto-assets. MiCA also includes pro­visions for consumer protection, mon­ey laundering, accountability of crypto-assets service providers, market abuse, change in control regimes, ESG, and administrative measures and penalties.

Due to the COVID-19 contingency, on May 1, 2020, it was published on the official website of the Mexican Copyright Institute (INDAutor) the official communication by means of which the suspension of activities and terms that ran from March 26 to April 30, 2020 has been extended. Extension of the suspension in the activities of the Mexican Antitrust Commission and its procedures

The Board of the Commission, in its session held today, decided that the initial suspension of terms period (March 23 until April 17) will be extended. In this regard, all terms will be suspended until April 30, 2020; furthermore, considering that May 1, 2 and 5 are holidays, the activities will restart on May 6, excepting those related to merger control procedures and the issuance of opinions or decisions in the granting of licenses, concessions, permits and similar procedures.

Fifth extension of the suspension in the activities of the Mexican Antitrust Commission and its procedures

The Board of the Commission in its session held on June 8, which was published in the Official Gazette on June 12,1 decided that the initial (March 23 to April 17), the second (April 20 to April 30), the third (May 6 to May 29) and the fourth (June 1 to June 12) suspension of terms will be extended. The decree was approved by the House of Representatives (Camara de Diputados) on June 28, submitted to the Executive, and published today in the Official Gazette (DOF), entering into force the day following its publication.

Flexibility in the Prohibition on Temporary Importation of Textiles and Clothing under IMMEX Programmes
