Following up on our note published on August 30, 2023, the Decree adding article 216 Bis to the General Health Law, published on March 24, 2023, went into effect on September 20, 2023.

In December 2021, Congresswoman Ana Lilia Herrera Anzaldo submitted the initiative with draft Decree seeking to reform and addition various provisions of the General Business Corporations Law (the “Law”), same that was already approved by the Plenary of the Senate of the Republic last September 12, 2023 (the “Initiative”).

On June 8, 2023, NOM-037-STPS-2023 issued by the Ministry of Labor and Social Welfare (“STPS”) was published in the Official Gazette of the Federation (“DOF”), which establishes the safety and health conditions for workers performing Telework, in order to prevent accidents and illnesses, as well as promote a safe and healthy environment
in the place of work (hereinafter “NOM-037”).

On 8 June 2023, the Supreme Court of Justice (SCJN) ruled on the constitutional complaint filed by the Federal Commission for Economic Competition (processed under case no. 94/2021), annulling the decree which enacted the Law for the Transparency, Prevention, and Combat of Improper Practices in Advertising Contracting, considering that the Congress of the Union had violated the legislative procedure.

On June 5, 2023, the “Decree promoting investment by taxpayers who carry out productive economic activities within the Development Poles for the Welfare of the Isthmus of Tehuantepec” was published in the Federal Official Gazette (DOF). This decree grants important tax benefits and administrative facilities to taxpayers who carry out certain productive economic activities in these poles.

On May 29, 2023, Resolution number A/018/2023 (the “Resolution”) of the Energy Regulatory Commission (“CRE”) entered into force, which generates a negative impact on the energy transition through various modifications to the applicable regulations to efficient cogeneration systems and, indirectly, has a significant impact on the form and requirements for the issuance of Clean Energy Certificates (“CELs”), as described below:

On May 18, 2023, the Resolution establishing the merchandise whose importation is subject to regulation of the Ministry of Labor and Social Welfare (the “Resolution”) published jointly by the Ministry of Economy (“SE”) and the Ministry of Labor and Social Welfare (STPS”), entered into force. On that same date, the Guidelines for the Implementation of the Mechanism to Restrict the Importing of Goods Produced with Forced or Compulsory Labor (the “Guidelines”) were published.

We inform you that on May 9, 2023, the Ministry of Health published in the Official Gazette of the Federation (“DOF”) the decree by means of which the Ministry declares the termination of the extraordinary general health action intended to prevent, control and mitigate the disease caused by the SARS-CoV-2 virus (Covid-19) (the “Decree”), which entered into force on the day following its publication.

On March 28, 2023, a bill of the Federal Executive Branch was submitted to Congress aiming to reform provisions of the Mining Law, National Water Law, General Ecological Balance and Environmental Protection Law, and the General Law for the Prevention and Integral Management of Wastes, which if passed as drafted will substantially impact how mining activities are carried out in Mexico (the “Bill Initiative”).
