Round One Contracts; Environmental Obligations Overview

Overview on the environmental obligations deriving from the Round One tender process.

Round One tender process began on December 11th, 2014, which is the procedure through which the National Oil and Gas Commission (Comisión Nacional de Hidrocarburos) offers to the private sector 169 areas for oil and gas extraction and exploration projects in deep waters, shallow waters and for non-conventional resources (shale gas), through a number of tenders. In this regard, within the Round One tender process, the CNH has issued 3 invitations to bid, two under the shared production structure and one through the license contracting format, for which we would like to provide an overview on the environmental obligations deriving thereof.

Article 29 Bis is added to the National Workers Housing Fund Institute Law in relation to Subcontracting

The purpose of this reform is to increase the investigative authority of INFONAVIT in relation to the companies that use a subcontracting regime.

On June 4th of this year the Decree adding article 29 Bis to the National Workers Housing Fund Institute (INFONAVIT) Law was published in the Official Federal Gazette. The purpose of this reform is to increase the investigative authority of INFONAVIT in relation to the companies that use a subcontracting regime (outsourcing) and, principally, to delineate the responsibility between the contracting company and the outsourcing company.

Definitive Bidding Guidelines and Production Sharing Contract First Call to Bid–Round One-Shallow Waters

The National Hydrocarbons Commission (CNH) has made the last amendments to the Bidding Guidelines for the First Invitation to Bid.

On May 29th and June 9th, 2015, the National Hydrocarbons Commission (CNH) made the last amendments to the Bidding Guidelines for the First Invitation to Bid, and the final draft of the Production Sharing Contract (the Contract.) With this, the bidding process's rules and conditions, and the final draft are already defined, giving legal certainty to all bidding process participants (the Bidders).

Reform in the Field to Combat Corruption

On April 22nd, 2015, the Chamber of Senators approved the constitutional reform in the area of fighting corruption. Now pending is the approval of the majority of the legislatures of the States which is required in order to pass a constitutional reform. Once this majority is attained it will be published in the Official Journal of the Federation.
