On 19 December 2024, a Decree published in the Official Journal of the Federation (DOF) prohibited the temporary importation of certain goods from the textile and clothing sector. This measure significantly disrupted industry operations, compelling companies to suspend activities and adjust their supply chains due to restricted access to critical inputs. The sector experienced widespread unease, raising concerns about the potential economic consequences of this provision.

On January 10th, 2025, the National Institute of Statistics and Geography (INEGI) published in the Official Federal Gazette (DOF) the updated daily, monthly and annual values of the Measurement and Updating Unit (UMA), with an increase of 4.21%. These new values will come into effect on February 1st. 2025.

The Electronic Bidding and Opinion Request System (SISELO) of the Federal Economic Competition Commission (COFECE) starts operations

On 8 June 2023, the Supreme Court of Justice (SCJN) ruled on the constitutional complaint filed by the Federal Commission for Economic Competition (processed under case no. 94/2021), annulling the decree which enacted the Law for the Transparency, Prevention, and Combat of Improper Practices in Advertising Contracting, considering that the Congress of the Union had violated the legislative procedure.

On June 5, 2023, the “Decree promoting investment by taxpayers who carry out productive economic activities within the Development Poles for the Welfare of the Isthmus of Tehuantepec” was published in the Federal Official Gazette (DOF). This decree grants important tax benefits and administrative facilities to taxpayers who carry out certain productive economic activities in these poles.

On May 29, 2023, Resolution number A/018/2023 (the “Resolution”) of the Energy Regulatory Commission (“CRE”) entered into force, which generates a negative impact on the energy transition through various modifications to the applicable regulations to efficient cogeneration systems and, indirectly, has a significant impact on the form and requirements for the issuance of Clean Energy Certificates (“CELs”), as described below:

On May 18, 2023, the Resolution establishing the merchandise whose importation is subject to regulation of the Ministry of Labor and Social Welfare (the “Resolution”) published jointly by the Ministry of Economy (“SE”) and the Ministry of Labor and Social Welfare (STPS”), entered into force. As we mentioned in part three of the document "ESG in the Mexican Mining Industry", climate change and energy efficiency issues, now more than ever, play a very relevant role in the industry. This is because in the mining sector, most of the greenhouse gas ("GHG") emissions are directly related to energy consumption. GHG emissions are mainly produced by the burning of fossil fuels to supply electricity to the mines, as well as to power equipment and vehicles for the extraction and processing of minerals and metals. This intensive energy consumption is expected to increase exponentially in the coming years.

We inform you that on May 9, 2023, the Ministry of Health published in the Official Gazette of the Federation (“DOF”) the decree by means of which the Ministry declares the termination of the extraordinary general health action intended to prevent, control and mitigate the disease caused by the SARS-CoV-2 virus (Covid-19) (the “Decree”), which entered into force on the day following its publication.

On March 28, 2023, a bill of the Federal Executive Branch was submitted to Congress aiming to reform provisions of the Mining Law, National Water Law, General Ecological Balance and Environmental Protection Law, and the General Law for the Prevention and Integral Management of Wastes, which if passed as drafted will substantially impact how mining activities are carried out in Mexico (the “Bill Initiative”).

On February 28, 2023, “Resolution No. A/004/2023 of the Energy Regulatory Commission (“CRE”), resuming legal deadlines and terms in an orderly and staggered manner, which modifies Resolution A/001/2021 establishing the suspension of legal deadlines and terms, as a measure to prevent and combat the spread of the coronavirus COVID-19” (the “Resolution”), was published in the Federal Official Gazette (“DOF”), thereby establishing that the deadlines and legal terms regarding the acts and procedures before the CRE that were suspended will resume as of March 1, 2023.
