Suspension of terms and deadlines for the Mexican Energy Control Center

Today, the National Center of Energy Control ("CENACE") published in the Federal Official Gazette the "Agreement establishing the suspension of terms and deadlines in acts and procedures filed before the Administrative Entities of the National Center of Energy Control, from Thursday, March 26 through Sunday, April 19, 2020” (the “Agreement”).


The Agreement provides that the terms and deadlines for the procedures filed before the Administrative Entities of CENACE will be suspended, during the period from March 26 through April 19, 2020.


Likewise, the Agreement provides that the terms established for the fulfillment of obligations established in laws, regulations, provisions, administrative acts or in any type of contract, will be extended until April 20, 2020.


The foregoing is also applicable for those cases where CENACE must issue a response or resolve anything regarding acts or procedures established in laws, regulations, provisions or administrative acts.


The suspension of terms and deadlines includes, all procedures filed before the Interconnection and Connection Request Service System (SIASIC), which are related to the Manual for the Interconnection of Power Plants and Connection of Load Centers. This includes interconnection and connection studies as well as the execution of the respective interconnection and connection contracts.


Also, the Agreement refers that the reception of Guarantee Instruments referred to in the Fulfillment Guarantee Manual are exempt of the legal terms suspension, so wholesale electricity market participants may keep the guaranteed payment amount at a level equivalent to the greater of (i) the minimum value of the basic fulfillment guarantee and (ii) the estimated aggregated liability.


Furthermore, the Agreement establishes that CENACE’s document reception office will remain open, to receive any writ, notice or report, from Monday to Friday from 09:00 to 13:00 hours.


Finally, the Agreement refers that the procedures and contractual obligations derived from the Public Sector Acquisitions, Leasing and Services Law that are necessary for the essential activities of CENACE are exempt from the suspension of the terms and deadlines stablished in the Agreement.
