Changes to the Foreign Trade Rules issued by the Ministry of Economy

Today the Ruling amending how the Ministry of Economy issues General Foreign Trade Rules and Requirements was published in the Official Federal Gazette and it will enter into force tomorrow, December 10, 2019.



One of the most relevant changes is that companies that operate under IMMEX and PROSEC programs may only add new domiciles to operate under these programs when they have obtained a certification of facts witnessed by a notary public with respect to such domicile which must be transferred to the competent authority in accordance with certain requirements.


Such certification must specify, among other things, the status of the possession of the property and its condition, the inventory of the machinery and equipment that is located on the property, the description of the merchandise to import, and the situation of the personnel hired both directly and through outsourcing.


It is also important to mention the change of several sections of the "NOMS Ruling", to eliminate tariff codes that are outside the scope of application of various Official Mexican Standards, and to include others subject to compliance with certain standards at the time they are imported.
