The regularization of foreign vehicles illegally located in Mexico is “formalized”

On January 19, 2022, the “Decree promoting the regularization of used vehicles” was published in the Federal Official Gazette, which contains the guidelines and requirements for regularizing certain used vehicles from abroad whose legal stay in Mexico cannot be evidenced.


Vehicles assembled in the United States of America (USA), Mexico and Canada classified under certain specific tariff codes and that, as of October 19, 2021, were located in the states of Baja California, Baja California Sur, Chihuahua, Coahuila, Durango, Michoacán, Nayarit, Nuevo León, Sonora and Tamaulipas, can be regularized. Only the residents of those states can regularize a maximum of one vehicle, as of today and until July 20, 2022.


In addition, only vehicles with a model year of eight or more years prior to the date of regularization are eligible. The regularization will be carried out through a definitive import declaration through a Customs Agent and the payment of a single charge of two thousand five hundred pesos. The definitive import of the vehicle will not be subject to the payment of taxes or fines, nor will it be necessary to have a prior import permit, certificate of origin or registration in the Importers Registry.


The following vehicles may not be regularized: vehicles whose circulation is prohibited in Mexico or the USA; luxury or sports vehicles; those that do not comply with the physical-mechanical or environmental protection conditions applicable to vehicles; and those reported as stolen or involved in the committing of a crime.


This is a decree that raises various questions regarding its regularization process and that in the end could become an incentive for the illegal introduction into the country of a greater number of used vehicles for their subsequent regularization and sale throughout Mexican territory.
