Revised Notice. Impact of the COVID-19 in the activities of the Mexican Antitrust Commission and its procedures

The Mexican Antitrust Commission (“Commission”) published a revised notice, stating the following:

The Board of the Commission, in its session held today decided that effective as of March 23, all terms will be suspended until April 17, 2020, excepting those related to merger control procedures and the issuance of opinions or decisions granting licenses, concessions, permits and similar procedures.



The procedures not included in this suspension are the following: (i) pre-merger filings; (ii) the issuance of opinions or decisions granting licenses, concessions, permits and similar procedures; and (iii) review the obligation to notify a transaction when it was legally mandatory to do so.


The pre-merger filing procedures are executed mainly through electronic filing system, hence, the exposure to COVID-19 is low.


All writs and notices filed with the Commission during the suspension period and not related to the procedures above mentioned will be considered submitted on April 20.
