Impacts of the COVID-19 in the activities of the Mexican Antitrust Commission and its procedures

The Board of the Mexican Antitrust Commission, in its session held today, decided that effective as of March 23, all terms will be suspended until April 17, 2020, excepting those related to merger control procedures.


The procedures not included in this suspension are the following: (i) pre-merger filings; (ii) the fulfillment of remedies imposed as a consequence of a pre-merger filing; and (iii) review the obligation to notify a transaction when legally it was mandatory to do so. In relation with these three procedures, the timing of the merger review process is not expected to be affected during the COVID-19 outbreak.


The pre-merger filing procedures are executed mainly through an electronic filing system, hence, physical contact is low.
