Nallely advises national and international corporations, as well as individuals, in intellectual property matters, including distinctive signs, collective trademarks, certification trademarks and domain names. In particular, she conducts searches to determine viability of use and registration before the Mexican Industrial Property Institute (IMPI) and international bodies. She also analyzes and responds to official notices of requirements, prior registrations, legal impediments and trademark registration denials. She has advised companies in the design and implementation of legal strategies that expand the protection of their intellectual property rights; in the analysis of direct and indirect competition and legal risks; in due diligence procedures; in the appropriate classification of products and services according to the Nice Classification and IMPI’s criteria; in the determination of strategies for the defense of rights in opposition proceedings, and in the preparation, negotiation and execution of assignment contracts, license agreements and co-existence agreements, including registration before the IMPI and international offices.
