Possible criteria for verifying compliance with the NOM-051-SCFI/SSA1-2010 in the point of sale of products, beginning on October 1, 2020

The Standards Office (DGN) and the Federal Commission for Protection from Sanitary Risks (COFEPRIS), published on the page of the National Commission for Regulatory Improvement (CONAMER) the draft of the “Ruling establishing the criteria for the implementation, verification and oversight, as well as the evaluation of conformance with the Amendment of the Official Mexican Standard NOM-051-SCFI/SSA1-2010, General labeling specifications for prepackaged food and non-alcoholic beverages-Commercial and health information, published in the Official Federal Gazette on March 27, 2020 (Implementation Ruling).”


The Implementation Ruling establishes that beginning on October 1, 2020, the authority will verify in the point of sale that the food and non-alcoholic beverages comply with the warning stamps and captions indicated in the NOM-051- SCFI/SSA1-2010. With this, the complexity of modifying the packaging and the rotation of inventories of the affected companies is ignored.


The DGN and the COFEPRIS argue that the Draft of the Implementation Ruling does not represent more expenses or obligations for the private parties, and therefore they are requesting exemption from the review process before the CONAMER. In this regard, it is advisable to immediately present comments on the review process to show the true impact that this change of criteria would generate for the industry.
