The key elements to consider in this reform are as follows:
• It will be the employer's obligation to provide a sufficient number of seats or chairs with backrests to all workers, applicable to the service, commerce, and similar sectors, including industrial establishments when their nature permits.
• These seats or chairs with backrests must be located in a physical space within the workplace and periods must be designated for their use during the workday.
• It is incorporated as a prohibition for employers to require their workers to remain standing throughout the entire workday, or to prohibit them from sitting periodically during the workday.
• The Internal Work Regulations must include rules that regulate the workers' right to use the seats provided by the employer.
The reform will come into effect 180 calendar days after its publication in the DOF in order for employers to adjust their internal regulations to be able to comply with the new provisions. Once it comes into effect, the Ministry of Labor and Social Welfare must issue the corresponding regulations on occupational risk factors within no more than 30 calendar days after the reform comes into effect.
