Entry into Force of the Chair Law

Last Tuesday, June 17, 2025, the decree commonly known as the “Chair Law” came into force, published in the Official Gazette of the Federation on December 19, 2024, through which various provisions of the Federal Labor Law were reformed and added (the “Decree”). This Decree establishes the obligation for employers in the service, commerce, and analogous work center sectors to provide all workers with a sufficient number of chairs with backrests.

Last Tuesday, June 17, 2025, the decree commonly known as the “Chair Law” came into force, published in the Official Gazette of the Federation on December 19, 2024, through which various provisions of the Federal Labor Law were reformed and added (the “Decree”). This Decree establishes the obligation for employers in the service, commerce, and analogous work center sectors to provide all workers with a sufficient number of chairs with backrests—without specifying a minimum number or exact proportion—for use during the performance of their duties or, where applicable, during periodic breaks. These chairs must be located in specific areas within the workplace facilities.

Furthermore, the Decree expressly prohibits employers from requiring their workers to remain standing throughout the entire workday or preventing them from sitting periodically while performing their duties.

Although the Decree only came into force on June 17, 2025, employers will have a period of 180 calendar days (6 months) from that date to adjust their internal work regulations, internal policies, and working conditions in accordance with the established provisions. Additionally, the Ministry of Labor and Social Welfare still needs to issue the applicable guidelines on workplace risk factors within a maximum period of 30 calendar days from the entry into force of the Decree.
