In the column “ESG, a new frontier for lawyers,” published by Expansión, our partner Pablo Jiménez examines the role of legal and compliance teams within an environmental, social and governance (ESG) strategy.
Pablo notes that while ESG management requires a multidisciplinary and cross-functional approach, lawyers play an important role in identifying and prioritizing legal and reputational risks, monitoring obligations and commitments, and advising on disclosures to prevent greenwashing risks. This perspective also extends to transactions such as mergers and acquisitions, strategic alliances and financings.
The article also addresses lawyers’ involvement in internal investigations, regulatory inquiries and ESG-related litigation. In this context, Pablo argues that the evolution of ESG creates an opportunity for both in-house and external counsel to broaden their capabilities and contribute more strategically to risk management and business objectives.
