Compliance checks for tax evasion

Compliance checks for tax evasion

October, 2026

The seventh edition of Latin Lawyer’s The Guide to Corporate Compliance examines ultimate beneficial ownership requirements and key risks associated with tax noncompliance in Mexico.

Our partners Luis Enrique Torres and Ricardo Cacho authored the chapter “Compliance checks for tax evasion” for the seventh edition of Latin Lawyer’s The Guide to Corporate Compliance, examining the evolving tax compliance landscape in Mexico and the risks it presents for companies.

The chapter addresses two closely connected areas: ultimate beneficial ownership (UBO) requirements and the broader criminal tax enforcement framework, including tax fraud, simulated transactions, documentary integrity offences, mandatory pretrial detention and precautionary account freezing.

Against this backdrop, the authors highlight the importance of maintaining accurate corporate information, documenting the economic substance of transactions and implementing robust internal controls as safeguards against administrative, criminal and reputational risk.

The authors also acknowledge the contributions of our associates Brenda de la Cruz, Miguel Angel Chinchilla, Maria Elisa Vera and Alejandro Ávila to the chapter.
