Simplification and Regulatory Improvement of Procedures in AML Matters

On June 9, 2025, Agreement 77/2025 was published in the Official Gazette of the Federation (DOF), through which the Ministry of Finance and Public Credit (SHCP) adopts administrative simplification and regulatory improvement measures that directly impact various procedures related to the Federal Law for the Prevention and Identification of Operations with Illicit Resources (LFPIORPI).

On June 9, 2025, Agreement 77/2025 was published in the Official Gazette of the Federation (DOF), through which the Ministry of Finance and Public Credit (SHCP) adopts administrative simplification and regulatory improvement measures that directly impact various procedures related to the Federal Law for the Prevention and Identification of Operations with Illicit Resources (LFPIORPI).

The agreement contemplates two types of measures:

1. Merger of procedures without changes in deadlines or formats: The following procedures, which were previously processed under different homoclaves, are merged, with deadlines and means of submission remaining unchanged:
A. Submission of notices and reports with the following modalities:
• Notice without operations
• Notice for carrying out vulnerable activities
• 24-hour notice (when there are indications of illicit resources)

B. Registration and enrollment of those who carry out vulnerable activities, and updating of information.
(Merger of homoclaves SHCP-05-006-A and SHCP-05-006-B)

2. Assignment of specific response deadlines and official formats: For the following procedures, which mostly lacked specific deadlines and were submitted in free writing, maximum response deadlines and official formats for submission are now established:
• SHCP-05-005: Request for authorization to use alternative compliance means – 20 calendar days.
• SHCP-05-007: Request for extension for the delivery of required information – 10 calendar days.
• SHCP-05-009: Request to submit notices through a collegiate entity – 80 calendar days.
• SHCP-05-010: Request for administrative interpretation of the LFPIORPI and its secondary regulations – 80 calendar days.

These provisions aim to standardize the reception of requests, reduce procedural ambiguities, and strengthen regulatory transparency, benefiting the obligated parties and the authorities responsible for overseeing regulatory compliance.

The agreement comes into force 30 business days after its publication, that is, approximately in mid-July 2025.
