Amendment to the Internal Regulations of the Federal Court of Administrative Justice

On January 31, 2024, the “Agreement SS/4/2024 amending the Internal Regulations of the Federal Court of Administrative Justice” was published in the Official Gazette of the Federation, whereby it is established that the 3 Chambers Specialized in Foreign Trade Matters will revert to being Ordinary Regional Chambers.

Based on the inventory conducted from January to November 2023, the Governing and Administration Board of the Federal Court of Justice (“TFJA”) noted that 97,004 complaints were filed throughout the Court, of which only 1,864 were complaints concerning foreign trade matters, representing just 1.9% of the total new complaint filings. Therefore, the Superior Chamber of the TFJA deemed it appropriate to transform the First Chamber Specialized in Foreign Trade Matters into the Fourth Metropolitan Regional Chamber; the Second Chamber Specialized in such matters into the Fourth Northeast Regional Chamber; and removed the specialized character of the Third Chamber Specialized in such matters so that the latter would function solely as the Second Gulf Regional Chamber. In accordance with the transitory articles of said Agreement, the new Ordinary Regional Chambers will continue to hear the proceedings currently docketed before them under their extinct specialized jurisdiction in foreign trade matters until such proceedings are deemed fully concluded. It is important to mention that, pursuant to the third of the transitory articles, the amendments to the Internal Regulations will enter into force as of April 1, 2024. In this regard, as of April 1, 2024, proceedings in foreign trade matters will be heard by the Ordinary Regional Chambers, in accordance with the corresponding territorial jurisdiction.
