Relaxation of the Temporary Import Ban on Textiles and Apparel under IMMEX Programs

On December 19, 2024, through a Decree published in the Official Gazette of the Federation (DOF), the temporary importation of certain goods from the textile and apparel sector was prohibited. This measure had a significant negative impact on companies in the industry, which were forced to suspend operations and make adjustments to their supply chains due to the lack of access to critical inputs.

This measure had a significant negative impact on companies in the industry, which were forced to suspend operations and make adjustments to their supply chains due to the lack of access to critical inputs. The provision generated widespread discontent in the sector, along with concerns about its potential economic consequences.

In response to pressure from companies and associations in the sector, on January 13, 2025, the Undersecretariat of Industry and Commerce issued Official Letter 400.2025.001, which exceptionally and temporarily allows the importation of the affected goods under the IMMEX program, provided certain requirements are met. Among these is the obligation to submit a free-form letter to the Ministry of Economy (SE) providing access to the company's inventory control system (Annex 24), demonstrating that the company holds a valid VAT and IEPS Certification and is not under a suspension or cancellation procedure, and proving that the tariff headings subject to the request were imported during the last calendar year.

It is important to note that this measure is strictly temporary and could cause severe impacts in case of a denial due to errors in the application, as no new request will be allowed. This mechanism will be in effect only until July 12, 2025, which underscores the need to act with precision and speed to take advantage of this relaxation.
