Suspension of deadlines and terms for the National Energy Control Center

Today the National Energy Control Center (“CENACE”) published in the Official Gazette of the Federation the “Agreement declaring the suspension of terms and deadlines in the acts and proceedings conducted before the Administrative Units of the National Energy Control Center, from Thursday, March 26 to Sunday, April 19, 2020” (the “Agreement”).

The Agreement establishes that the deadlines for the procedures that the general public pursues before CENACE’s Administrative Units shall not run during the period from March 26 to April 19, 2020. Likewise, the Agreement provides that, for those terms for the performance of an obligation that have been set forth in any law, regulation, provision, administrative act, or in any type of contract, the deadline shall be extended until April 20, 2020. The foregoing also applies to those cases in which CENACE must rule or decide on any act or proceeding established by any law, regulation, provision, or administrative act. The suspension of terms and deadlines under the Agreement includes, by way of example, all procedures related to the System for Handling Interconnection and Connection Requests (SIASIC), which derive from the Manual for the Interconnection of Power Plants and Connection of Load Centers. This includes interconnection and connection studies, as well as the execution of the respective interconnection and connection contracts. Excepted from the provisions of the Agreement is the receipt of Guarantee Instruments referred to in the Manual of Performance Guarantees, so that participants in the wholesale electricity market may maintain the guaranteed payment amount at a level equivalent to the greater of (i) the minimum value of the basic performance guarantee and (ii) the aggregate estimated liability. On the other hand, the Agreement states that, during the referenced period, CENACE’s document filing office shall remain open in order to receive any brief, notice or report, Monday through Friday from 9:00 a.m. to 1:00 p.m. Finally, the Agreement states that excepted from the aforementioned suspension of terms and deadlines are the procedures and contractual obligations arising from the Law on Acquisitions, Leases and Services of the Public Sector that are necessary for the continuity of CENACE’s essential activities.
