The regularization of foreign vehicles illegally located in Mexico is “formalized”

On January 19, 2022, the “Decree promoting the regularization of used vehicles,” which contains the guidelines and requirements to regularize certain used vehicles of foreign origin whose legal stay in Mexico cannot be evidenced, was published in the Federal Official Gazette.

Vehicles assembled in the United States of America (USA), Mexico and Canada, classified under certain specific tariff headings and which, as of October 19, 2021, were located in the states of Baja California, Baja California Sur, Chihuahua, Coahuila, Durango, Michoacán, Nayarit, Nuevo León, Sonora and Tamaulipas, are eligible for regularization. Only residents of those states may regularize a maximum of one vehicle, from today until July 20, 2022. Additionally, only vehicles whose model year is eight or more years prior to the date of regularization are eligible. The regularization will be carried out by means of a definitive importation customs declaration through a Customs Broker and the one-time payment of a fee of two thousand five hundred pesos. The definitive importation of the vehicle will not be subject to the payment of duties or fines, nor will it be necessary to have a prior import permit, certificate of origin or registration in the Importers Registry. The following, among others, may not be the object of regularization: vehicles whose circulation is prohibited in Mexico or in the USA; luxury and sports vehicles; those that do not comply with the physical-mechanical or environmental protection conditions applicable to vehicles, as well as those reported as stolen or involved in the commission of a crime. This is a decree that raises various questions regarding the regularization process itself and that, ultimately, could translate into an incentive for the illegal introduction into the country of a greater number of used vehicles for their subsequent regularization and sale throughout the national territory.
