On April 6, 2020, the Ministry of Environment and Natural Resources (“SEMARNAT”) published in the Official Gazette of the Federation the “AGREEMENT enabling days and hours for the administrative units indicated, so that they may carry out the administrative acts inherent to the procedures and proceedings specified.” (“Agreement”).
The Agreement enables days and hours to carry out administrative acts by and before SEMARNAT in certain matters, procedures and proceedings in accordance with what is specified in the Agreement. Likewise, it defines certain processes and activities that will not be subject to the suspension of terms and deadlines originally granted by the “Agreement by which the general public is informed of the days that will be considered non-business days for purposes of the administrative acts and proceedings conducted by the Ministry of Environment and Natural Resources and its decentralized administrative bodies” published in the Official Gazette of the Federation on March 24, 2020. In this regard, the Agreement establishes the following: Matter Agencies Enabled days and hours Procedures and proceedings Forestry. I. General Directorate of Forest and Soil Management. II. Federal Delegations of the Ministry of Environment and Natural Resources. Enabled from 10:00 a.m. to 2:00 p.m. on March 24, 26 and 31, as well as April 2, 7, 14 and 16, 2020. a) Request for forestry shipment permits to certify the legal origin of forest raw materials. Modality A. First-time and Modality B. Subsequent procedure. b) Request for forestry re-shipment permits to certify the legal origin of forest raw materials. Modality A. First-time and Modality B. Subsequent procedure. c) Phytosanitary Import Certificate/Phytosanitary requirements sheet for the importation of forest raw materials, products and by-products. d) Phytosanitary Certificate of export or re-export. Chemical Substances and Hazardous Waste. I. General Directorate of Integrated Management of Materials and Hazardous Activities. Enabled from 10:00 a.m. to 2:00 p.m. on March 24, 26 and 31, as well as April 2, 7, 14 and 16, 2020. a) Authorization for the importation of pesticides, plant nutrients, and toxic or hazardous substances and materials. b) Authorization for the exportation of hazardous materials. c) Notice of materials imported under a temporary regime and return of their hazardous waste. d) Authorization for the Transboundary Movement of Hazardous Waste and Other Waste Provided for in International Treaties. Atmospheric emissions. I. General Directorate of Air Quality Management and the Registry of Emissions and Transfer of Pollutants. Protected Natural Areas. I. The activities and deadlines provided for the Conservation Program for Sustainable Development (PROCODES), for fiscal year 2020, will not be suspended. II. The activities and deadlines provided for the Program for the Protection and Restoration of Ecosystems and Species at Risk (PROREST), for fiscal year 2020, will not be suspended. Procurement, leasing and services procedures. I. The activities and deadlines provided for in procurement, leasing and services procedures and in matters of public works, as well as the formalization of the corresponding legal instruments, whose performance is of extreme urgency or necessary for the continuity of operations of SEMARNAT and its decentralized administrative bodies, will not be suspended.
