Upcoming Entry into Force of NOM-037

As you may recall, on June 8, 2023, NOM-037-STPS-2023, issued by the Ministry of Labor and Social Welfare (“STPS”), was published in the Official Gazette of the Federation (“DOF”).

Said Standard establishes the safety and health conditions for workers under the Telework modality, in order to prevent accidents and illnesses, as well as to promote a safe and healthy environment in the workplace (hereinafter “NOM-037”). According to the publication in the DOF, NOM-037 will enter into force 180 calendar days after such publication. That is, as of the upcoming December 5, 2023, companies and employees under the Telework modality must comply, without exception, with the obligations established by NOM-037. Likewise, we remind you that compliance with this Standard may be verified in the inspections carried out by the STPS, and non-compliance could result in the imposition of fines.
