On December 27, 2024, a reform to Article 132 of the local Fiscal Code was published in the Official Gazette of Mexico City, imposing a new informative obligation for owners or holders of residential properties with high cadastral value (ranges L to P, equivalent to values equal to or greater than $4,524,974.08). Starting from the fiscal year 2025, these taxpayers must annually submit an informative declaration on the occupancy status of the property to the Secretariat of Administration and Finance. This obligation is purely statistical and does not generate legal effects, sanctions, or tax contingencies, even if the taxpayer refuses to provide the information.

Key aspects:
• Purpose of the obligation: Improve urban planning and the quality of the cadastral registry through updated information on the occupancy of high-value residential properties.
• Deadline: The declaration must be submitted no later than June 30 of each year, exclusively by electronic means.
• Required content:
◦ Taxpayer data and property account
◦ Occupancy category: owner, family members, friends, loaned, rented, or “other status”
◦ Indication of whether the property was permanently inhabited during the previous year
◦ Option to refuse to declare, without penalty
• Informative nature:
◦ Does not imply recognition of ownership or possession
◦ Does not generate tax credits or fines
◦ The data will be protected in accordance with applicable regulations

This measure focuses on a segment of properties with high turnover or change of use and seeks to strengthen housing policies, urban development, and local tax collection.
