National Energy Commission Resumes Activities: Official Deadlines and Timeframes Announced

June, 2025

The resolution resumes several proceedings before the National Energy Commission, establishes rules for ratifying pending matters and keeps certain procedures suspended until the corresponding secondary regulations are issued.

On June 5, 2025, the “Resolution by which the deadlines and timeframes for the receipt and processing of matters under the jurisdiction of the National Energy Commission are resumed, in accordance with the powers conferred and transferred to it, and which establishes the strategy for their handling” (the “Resolution”) was published in the evening edition of the Federal Official Gazette. The Resolution entered into force on June 6, 2025.

The Resolution forms part of the implementation of Mexico’s new secondary energy legislation, under which the Energy Regulatory Commission (“CRE”) was dissolved and its powers were transferred to the National Energy Commission (“CNE”).

One of its main effects is to lift the 90-calendar-day suspension of deadlines established under the Eighth Transitory Article of the National Energy Commission Law. Beginning June 6, 2025, the CNE resumed the receipt, processing and resolution of several matters within its jurisdiction.

Certain proceedings, however, will remain suspended until the regulations implementing the new energy legislation are issued. These include:

• Applications for new power generation permits, except for projects located in electricity-deficient regions.

• Applications for new retail permits for natural gas, petroleum products and liquefied petroleum gas.

• Applications for new distribution permits for petroleum products, including liquefied petroleum gas, through means other than pipelines.

• Applications for new marketing permits for natural gas, petroleum products, liquefied petroleum gas and petrochemicals, except for priority projects in deficient regions.

• Applications involving changes to a permit holder’s capital structure that result in changes of corporate control or management, as well as certain updates resulting from changes in shareholding structures or commercial branding.

• Applications for the determination or adjustment of rates, prices and tariffs applicable to the distribution, pipeline transportation and storage of natural gas, petroleum products and liquefied petroleum gas.

The Resolution also establishes an important requirement for proceedings initiated before the former CRE that remained pending as of March 18, 2025.

Interested parties must ratify before the CNE their intention to continue such proceedings no later than June 19, 2025, using the form made available by the Commission.

Ratification may be filed electronically through the CNE’s Electronic Filing Office or physically at its official offices.

Failure to ratify within the applicable period will be deemed a waiver of the interested party’s intention to continue the proceeding. Following the corresponding certification, the CNE will consider the matter closed and archived.

The Resolution also establishes operational rules governing the transition from the CRE to the CNE. Key provisions include:

• Submissions filed during the suspension period will be deemed formally received as of the Resolution’s effective date.

• Regulations previously issued by the CRE will remain applicable to the extent they do not conflict with the new energy legislation.

• The Electronic Filing Office will remain available for the submission of filings and applications.

• Specific rules are established for regularizing compliance reports that became due during the suspension period from March 19 through June 5, 2025.

• Certificates issued during the suspension period by Inspection Units for Power Plant Interconnection and Load Center Connection must be regularized within 30 calendar days, by July 5, 2025.

For permit holders, developers and other energy-sector participants, it is particularly important to determine whether they have pending proceedings before the former CRE and whether ratification or regularization before the CNE is required to preserve their continuity.

Von Wobeser y Sierra is available to assist with the regularization and follow-up of proceedings before the CNE and with compliance obligations arising from this regulatory transition.
