The Restriction on the Sale of Products Containing Trans Fats Is Now in Force

Following up on our note published on August 30, 2023, on September 20 the Decree adding article 216 Bis to the General Health Law, published this past March 24, 2023, entered into force.

As we previously mentioned, this new provision seeks to limit the consumption of trans fats in order to prevent diseases associated with this compound, present in various foods, fats, and oils. Although the Decree indicates that the Ministry of Health will establish the specific regulatory bases for industrially produced trans fatty acids, these have not been issued. Therefore, there is still no certainty regarding the regulatory procedures or the possible sanctions that would be applicable to the agri-food companies participating in this sector. Nevertheless, the restriction requiring that edible oils and fats, as well as non-alcoholic foods and beverages, not contain in their composition and in their presentation for sale to the public partially hydrogenated oils, and not exceed two parts of industrially produced trans fatty acids per one hundred parts of the total fatty acids, is already in force and enforceable. Consequently, compliance with such limitation may now be subject to verification and possible sanction by the Federal Government, as it has in fact already announced in various press releases.
