Impact of COVID-19 on the Activities of the Federal Economic Competition Commission and Its Proceedings

The Plenary of the Federal Economic Competition Commission, in the session held today, decided that, as of March 23 of this year, all time periods and terms will be suspended until April 17, 2020, except for those proceedings related to the control of concentrations.

The proceedings not included in this suspension of terms are the following: (i) the notification of concentrations, (ii) the monitoring of the conditions imposed on concentrations, and (iii) compliance with the obligation to notify a concentration when it should legally have been done. In relation to the three foregoing proceedings, the timeframe of the concentration review process is not expected to be affected during the COVID-19 outbreak. Concentration proceedings are conducted primarily by electronic means; therefore, physical contact is low.
