The Plenum of the Commission, in its session held today, resolved that the initial period of suspension of terms (March 23 to April 17) will be extended. In this regard, all time periods and terms will be suspended until April 30, 2020; likewise, considering that May 1, 2 and 5 are non-business days, the terms will resume being counted on May 6 of this year, with the exception of those proceedings related to merger control and the proceedings for
Additionally, the Commission included a list of proceedings for which the terms will continue to run normally, which are: (i) requests for formal opinions; (ii) general guidance; (iii) the opinions provided for in Article 12 of the Federal Economic Competition Law, sections XII, XIII, XIV, XV and XVIII; (iv) public consultations; (v) the immunity program; (vi) the benefit of exemption from or reduction of the amount of fines; (vii) the stage subsequent to the conclusion of investigations for monopolistic practices or unlawful concentrations; and (viii) the terms for the Plenum to issue a resolution in any proceeding, under certain conditions. All filings submitted before the Commission during the suspension period that are not related to the proceedings indicated above will be deemed submitted on May 6.
