In this chapter, the authors explore a wide range of relevant aspects of litigation in Mexico, consistently highlighting the distinctive features of the Mexican system that should be taken into account, particularly when comparing it to other jurisdictions. Following a highly dynamic, schematic question-and-answer format, the authors explain how the judicial system is organized, how lawsuits are initiated, the format for holding hearings, the rules on the production of documents and privilege, the damages that may be claimed, and the alternative dispute resolution mechanisms available to the parties, among many other topics. The chapter includes commentary on unclear or controversial aspects and identifies some of the open questions regarding litigation in Mexico, drawing on the authors' extensive experience in the Mexican forum.
