The Provisions require employers to identify risks associated with standing work, provide suitable seating and implement preventive ergonomic measures.
The new Provisions establish the minimum requirements employers must follow to provide a sufficient number and appropriate type of seats or chairs with backrests for employees who perform their activities standing, particularly in the service, trade, analogous establishment and industrial sectors, where the nature of the work allows.
The framework also establishes obligations for employees and introduces specific measures aimed at preventing risks associated with prolonged standing.
Key employer obligations include:
• Identifying and assessing risks associated with activities performed while standing, in accordance with the criteria established in the Provisions.
• Documenting risks and preventive measures in the minutes of the Joint Health and Safety Commission.
• Determining the applicable risk level together with the Commission, based on the parameters set out in the Provisions.
• Providing suitable seats or chairs with backrests, considering ergonomic criteria such as height, lumbar support, armrests and footrests, as applicable.
• Implementing preventive measures, including task rotation to allow changes in posture, ergonomic footwear and rest periods during the workday.
• Referring employees for medical attention when they experience discomfort or symptoms associated with standing work.
The Provisions entered into force on July 17, 2025. Employers subject to these requirements should therefore review their workstations, risk assessments, ergonomic measures and internal documentation to ensure compliance, together with the applicable obligations under the Federal Labor Law.
